Terms of Use, PiD Drift

These terms of use govern your use of the software system PiD Drift (hereinafter referred to as “the Service”), associated applications, and the linked website pid-drift.no (hereinafter referred to as “the Website”). The Service and the Website are provided by PiD Solutions AS.

By logging into, or otherwise using the Service or the Website, you agree to comply with the current terms and conditions.

Role and scope

Your access to the Service is made available by the property manager (Customer of PiD Solutions, hereinafter referred to as “the Customer”). Your access is either in the capacity of:

  • An employee of the Customer (the property manager).
  • An employee of a company that leases space from the Customer (e.g., a store that is a tenant in a shopping center).
  • An employee of a contractor or service provider who performs work related to the Customer’s properties.

The purpose is to perform operational tasks, internal control, and/or safety-related tasks related to the buildings. Your right of use is conditional on and subject to the applicable License and Service Agreement between PiD Solutions and the Customer.

Governing law

The Website and the Service are subject to and comply with Norwegian law, including legislation on privacy and copyright. Any legal relationship that may arise between PiD Drift and users is governed by Norwegian law. Any disputes shall be settled with jurisdiction in Norway.

General disclaimer

The content and the Service, as well as our terms as described here, are continuously updated as needed and can be changed by PiD Solutions at any time. Significant changes affecting the Service will be notified to the Customer (your employer/client) within a reasonable time. It is reserved that the pages may contain incomplete or inaccurate information, and that this cannot be invoked as a basis for claims.

PiD Solutions is the owner of the Website and holds all intellectual property rights to the content on the Website and in the Service. Unauthorized use of the Website, the Service, or the content is not permitted. Content published based on an agreement with another producer will also be protected by the producer’s copyright.

License and ownership of data

  • Right of Use: Access to the Service is personal, non-transferable, and is granted to you in your capacity as an employee, tenant, or contractor of the Customer. Your right to use the Service ceases when the customer relationship between PiD Solutions and the Customer ends, or if your affiliation with the Customer ends.
  • Customer Data: The Customer (your employer/client/landlord) retains ownership of all data entered and generated by you in the PiD Drift system (e.g., reports, inspection rounds, error messages, and images).
  • Commercial Use: Commercial entities or commercial use are not permitted to reproduce content from the website produced by PiD Solutions without permission.

Security, user responsibility, and privacy

Website security

The Website uses encryption to protect the electronic traces you leave. It is possible to leave the Website through links to external websites that have a lower security level. PiD Solutions takes no responsibility for security on websites we link to.

User’s security responsibility

  • Password Responsibility: The user is responsible for protecting their password and username and shall not share this with others. The user must immediately notify PiD Solutions or the Customer in case of suspicion of unauthorized access.
  • Equipment: The user of the Service is responsible for protecting their computer and mobile device, and ensuring that the equipment is updated and has satisfactory security.

Information on the use of PiD Drift Mobile (PiD Drift mobile application)

The following applies when using the app:

  • Camera/Location: You will need to grant access to your camera to perform inspection rounds.
  • Notifications: To send you notifications about errors and tasks, we use Google Firebase, and you can read their privacy policy here. You can choose to turn off notifications and location under settings on your phone, or by turning off notifications within the app itself.

Processing of Personal Data

This section describes how PiD Solutions AS processes your personal data in connection with your use of the Service. Note that PiD Solutions is the Data Processor, and that the processing takes place on behalf of the Customer, who is the Data Controller.

What kind of personal data do we store about you?

The personal data is collected to ensure correct delivery of the Service, as well as to safeguard the system’s security and operation.

  • Logs
    • Time, location (when actively using location-based functions), device, IP address, and possibly browser used when logging in.
    • Duration of session and navigation in pages.
    • Which forms you have filled out and when they were saved.
    • Which inspection rounds you have performed and when these were completed, as well as errors you have registered, commented on, or processed.
  • Contact and Affiliation Information
    • Name, phone number, username, password, and email address.
    • Affiliation: Store/premises/area, property, and address of the property.
    • Log of email activity (which emails you have received from us).
  • Course Information
    • Which types of courses you have completed.
    • Date of completion and expiry date of the course.
  • Digital Signature
    • Documentation that you have read and understood information given in this agreement or other relevant documents.

Who has access to the information?

Only personnel in PiD Solutions AS (Data Processor) have direct access to the personal data to be able to deliver, operate, and secure the Service.

The Customer (Data Controller), as well as companies the Customer has given permission to, have access. In the case of tenancy, the property’s or company’s managers will have access to information about you. The access for the Customer is limited to information visible in the user interface of the Service – not internal logs, email activity, and digital signature.

What is the information used for?

PiD Solutions uses your personal data primarily to deliver the Service and to communicate with you and the Customer. Anonymized data and usage patterns can be used to extract statistics for the purpose of analyzing and improving the Service.

PiD Solutions undertakes not to forward personal data to anyone other than the Customer and the company(s) the Customer has given permission to access.

Where is the information stored?

The Service (and your personal data) may be stored on a server within the EEA. It may occur that personal data is sent through publishing services for SMS, push messages, and email before reaching the recipient.

By using PiD Drift, you consent to the transfer of personal data to countries outside the EEA, provided that such transfer takes place in accordance with current legislation.

User’s responsibility for content

  • Unauthorized Data: In the Service, you have the ability to create and/or store documents and files. Documents containing personal data should not be uploaded to our system beyond what is necessary for the function of the Service or what we have requested/required to be submitted.
  • Responsibility: PiD Solutions is not responsible for personal data uploaded by our users in violation of this point.
  • Login Details: Information about username and password is considered private and shall not be forwarded or lent out so that others can log in with your user profile.

Protection of personal data

We take all reasonable precautions to protect your personal data against unauthorized access, modification, disclosure, or deletion.

  • Disclaimer: We emphasize that no methods of data transfer are 100% secure. PiD Solutions cannot guarantee that information is 100% protected against unauthorized access from intruders.
  • Illegal Acts: We are not responsible for illegal acts by third parties (such as hackers or intruders) who violate applicable law and/or the provisions of this user agreement, and who attempt to collect your personal data for personal gain.

Third-party services

PiD Solutions neither exchanges, sells, nor rents out users’ personal data to third parties.

PiD Drift may contain links to third-party websites. If you follow these, you must be aware that such websites have their own privacy policies. We are not responsible for their policies or any collection, use, or disclosure of personal data in that connection.

Your rights

Legislation gives you the right to see what personal data we have about you. You can request access to this information by contacting us at support@pids.no.

You can also request that we delete information about you, unless the law requires us to retain it. You can read more about your rights at the Norwegian Data Protection Authority here (link to the Norwegian Data Protection Authority).

Cookies

Cookies and analysis

By visiting the PiD Drift website, you agree that we use cookies to give you a better user experience.

  • Functional Cookies: Cookies are used to ensure that the system functions optimally (e.g., “_ga” is used to distinguish users).
  • Analysis: We use the statistics tool Google Analytics to analyze traffic and improve the Service. The tracking code anonymizes IP addresses.

Google analytics and cookies

We use the statistics tool Google Analytics to analyze traffic on the website and in the Service. The purpose is to improve functionality, user-friendliness, and content.

Examples of what the statistics tell us are:

  • how many people visit different pages
  • how long the visit lasts

None of the cookies allow us to link information about your use of the website to you as an individual. The Google Analytics tracking code anonymizes the IP address before the information is stored and processed by Google. All information is subject to Google’s privacy policy. Delete or block cookies

Most commonly used browsers are set up to automatically accept cookies. You can choose to change the settings in your browser’s settings menu if you do not want cookies to be stored on your device, or you can delete cookies you have previously accepted.

Please note: A large number of websites, including PiD Drift, will not function optimally if cookies are blocked.

What happens if the user agreement changes?

PiD Solutions AS may change the user agreement at any time so that you can stay well updated on our requirements for security and use of the Service and customer data. You will then have to approve the new agreement after logging into PiD Drift.
